Consig AI, Inc. Acceptable Use Policy (AUP)
Effective Date: July 1st, 2025
This Acceptable Use Policy (“AUP”) governs the use of the services offered by Consig AI, Inc. (“Consig AI,” “we,” “our,” or “us”), including but not limited to our website, cloud-based services, APIs, and related applications (collectively, the “Cloud Service”). This AUP forms part of the Terms of Service or Cloud Service Agreement between the Customer (“you” or “your”) and Consig AI.
We may update this AUP at any time. Changes will take effect upon posting to our website. Your continued use of the Cloud Service after changes are posted constitutes your acceptance of the revised AUP. Customers are responsible for reviewing this AUP periodically.
Consig AI reserves the sole right to determine whether any activity violates this AUP.
1. General Obligations
You agree to use the Cloud Service lawfully, ethically, and in compliance with all applicable laws and regulations. Prohibited activities include, but are not limited to, the following:
Service Integrity
• Negatively affecting the Cloud Service’s availability, reliability, or stability.
• Conducting or contributing to denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks.
• Circumventing or attempting to bypass any security mechanisms or authentication measures.
• Overusing or monopolizing service resources in a way that degrades performance for other customers.
Security & Access
• Misusing credentials, sharing passwords, or allowing unauthorized use of your Consig AI account or API keys.
• Gaining or attempting to gain unauthorized access to any systems, networks, or accounts.
• Transmitting or introducing harmful code, including viruses, worms, trojans, or spyware.
Legal & Regulatory Compliance
• Violating any applicable federal, state, provincial, or local laws in the United States, Canada, or any jurisdiction where you use the service.
• Violating the Telephone Consumer Protection Act (TCPA), Telemarketing Sales Rule (TSR), Canada’s Anti-Spam Legislation (CASL), or other applicable telemarketing, robocall, or electronic communications laws.
• Using the service to initiate calls, texts, or messages to any recipient without the required consent (including express written consent where applicable) or in violation of Do Not Call (DNC) regulations.
• Failing to honor opt-out requests promptly and in accordance with law.
• Engaging in any activity that exposes Consig AI or its customers to liability under HIPAA, PCI DSS, GDPR, or other applicable data protection laws.
Content Restrictions
• Transmitting content that infringes intellectual property rights or proprietary rights of others.
• Sending spam, unsolicited advertisements, or marketing messages in violation of applicable laws.
• Sending harassing, threatening, discriminatory, defamatory, obscene, or otherwise unlawful content.
• Misrepresenting your identity or the origin of communications.
• Harvesting or collecting personal information without lawful basis and express consent.
Prohibited Use Cases
• Offering or promoting illegal products, services, or activities.
• Using the Cloud Service for activities related to fraud, scams, phishing, or impersonation.
• Using the Cloud Service to contact emergency services (e.g., 911, E911) — Consig AI does not support emergency calls.
2. TCPA & Telemarketing Compliance
If you use Consig AI’s services for outbound calling, messaging, or other customer outreach, you must:
• Obtain all required consents under the TCPA and related laws before initiating communications.
• Maintain documentation of such consents and provide it to Consig AI upon request.
• Comply with all time-of-day restrictions, call frequency limits, and caller identification requirements.
• Honor Do Not Call requests and national/state DNC lists.
• Use only lawful dialing and messaging practices — no spoofing, war dialing, or random/sequential number generation unless permitted by law.
You are solely responsible for compliance with all applicable laws governing your communications, including ensuring your use of Consig AI services meets all telemarketing, robocall, and electronic messaging regulations.
3. Enforcement & Remedies
Violations of this AUP may result in any or all of the following, without notice:
• Suspension or termination of your account.
• Blocking or throttling of communications.
• Legal action, including claims for damages and injunctive relief.
• Cooperation with law enforcement, regulators, and affected third parties.
Consig AI’s failure to enforce any provision of this AUP does not constitute a waiver of its rights.
4. Emergency Services Disclaimer
Consig AI services do not support calls to emergency services (e.g., 911, E911). You must use an alternative method to reach emergency services. Consig AI, its officers, employees, and affiliates are not liable for any inability to access emergency services through its offerings.
5. Reporting Violations
To report a suspected violation of this AUP, contact abuse@consig.ai with sufficient detail for investigation.
